Terms and conditions

GENERAL
By placing an order, you agree to our general terms and conditions and these become part of the contract in the form in which they are published on our homepage at the time the contract is concluded. We reserve the right to change the general terms and conditions from time to time. Any additional agreements must be in writing.

PRICES
The prices stated in the web shop include the statutory sales tax of 20%, but exclude shipping costs. It is possible to adjust the price of individual products in the online shop. If you order from outside the EU, please note that customs duties or taxes may apply, which you must pay.

CONCLUSION OF CONTRACT
The presentation of our goods on the homepage does not constitute a legally binding offer, but rather a non-binding presentation of our product range.
By clicking the “Buy” button, you place a binding order for the goods contained in your shopping cart. Immediately after completing the ordering process, you will receive a confirmation of receipt of your order to the email address you provided.
A valid contract is concluded either upon receipt of this order confirmation or at the latest upon receipt of the goods. We reserve the right to withdraw if an item is not available despite being shown, if you have not paid invoices due to previous deliveries without justification, if your credit card check has not been completed successfully or there are doubts about your creditworthiness.
We also reserve the right to withdraw from the contract if we have made an error in the price. (typographical errors e.g. price only €1 instead of €100) If we are unable to carry out your order for the stated reason or for any other reason, we will notify you as quickly as possible and will immediately refund the payment you have made.

PAYMENT
If you decide to pay by credit card, payment will be processed via the payment service provider Stripe Payments Europe Ltd, Block 4, Harcourt Centre, Harcourt Road, Dublin 2, Ireland, subject to the Stripe Terms of Use https://stripe.com/de /terms. Normally we only send the goods after receipt of payment.
SHIPMENT
Unless otherwise agreed, goods will be delivered by shipping to the delivery address specified by the customer. As soon as we have shipped the goods, you will receive a shipping confirmation including the tracking number by email.
We ship our goods worldwide.

From a gross goods value of currently EUR 99 for customers within Austria and a gross goods value of currently EUR 199 for customers in Germany, Belgium, Italy, Luxembourg, the Netherlands, Slovakia and the Czech Republic, DR. SALOMON Wein GmbH will cover the delivery costs.
If the transport company returns the shipped goods to the seller because delivery to the customer was not possible, the customer will bear the costs for the unsuccessful shipping.
Furthermore, the customer is liable for incorrect address information.
RETENTION OF TITLE
The goods remain the property of Dr. until the purchase price has been paid in full. Salomon Wein GmbH.

COMPLAINTS, EXCHANGES
The goods must be inspected immediately upon receipt; broken bottles must be confirmed by the transporter.
Returns within 7 days of delivery. If the goods are returned, the buyer will receive a refund of the purchase price already paid, but must bear the costs of the return. In addition, an exchange can be made within 7 days of delivery during normal opening hours at the winery in Stein an der Donau.

CORK TASTE
Impairments caused by faulty cork are not the responsibility of the winemaker. Faulty bottles will be exchanged under the following conditions: The faulty bottle will be resealed with the bad cork and returned to the SALOMON UNDHOF winery in Stein/Donau.

ORDERS, DELIVERY TIME, DELIVERY, OBSTACLES
DELIVERY WILL BE CARRIED OUT BY AN AUTHORIZED FORWARDER AT ORDINARY BUSINESS HOURS. IN THE CASE OF NON-ACCEPTANCE OF ORDERED GOODS, DR. SALOMON WEIN GMBH IS ENTITLED TO REQUEST REPLACEMENT OF THE RESULTING ADDITIONAL EXPENSES, SUCH AS FRUSTRATED TRANSPORTATION COSTS.
Orders are accepted subject to delivery options. DR. SALOMON Wein GmbH reserves the right to allocate even small quantities to the purchaser if a product is oversubscribed.

RIGHT OF WITHDRAWAL
9.1. The buyer only has a right of withdrawal according to the Consumer Protection Act if he is a consumer within the meaning of the Consumer Protection Act and the contract was concluded at a distance. Points 9.2 – 9.4 do not apply to all other buyers.
9.2. The buyer as a consumer has the right to withdraw within fourteen working days after conclusion of the contract.
9.3. The buyer must declare his withdrawal in writing.
The withdrawal deadline is met by sending the declaration on time.
The withdrawal period begins on the day the goods are received by the buyer (consumer).
9.4. If the ordered goods have already been delivered to the buyer, the buyer will bear the direct costs of returning the goods in the event of his withdrawal from the contract.

WARRANTY
The statutory warranty regulations apply. If you discover a defect in the goods, please contact us immediately.
Color differences that may occur due to the different representations (digital and in nature) are not considered a defect. If you do not like the product in person, you can return it within 14 days.
SEVERABILITY
If individual provisions are invalid or lose their effectiveness, this will not affect the validity of the other provisions.
APPLICABLE LAW & JURISDICTION
Austrian law applies to all purchase contracts concluded via this website, excluding the UN Convention on Contracts for the International Sale of Goods and, unless other legal regulations derogate, the place of jurisdiction is Vienna.

Protecting your privacy is very important to us. Below we will inform you in detail about how your data is handled.
By entering your personal data, you agree that we may store this data and use it to fulfill your order and the associated obligations. We will treat your data as strictly confidential and in accordance with legal regulations. We pass on some of this data to the transport companies commissioned by us in order to process the order.

13.2 Data collection and use when visiting the website
In principle, you can visit our website without providing any personal information. However, every time a file is requested by your internet browser, access data (including the name of the page or file accessed, date and time, internet browser used, the page from which you came to us (referrer), screen resolution and operating system, etc.) is sent and evaluated by us for statistical purposes.

13.3 Data collection and use for orders in the web shop
When you order in our web shop, we collect the following data from you: first name, last name, company if applicable, street, postal code, city, country, telephone number, email address, selected shipping method, selected payment method and, if necessary, an individual text message. Providing this data is necessary for the processing, execution and billing of all purchases you make, otherwise you will not be able to order from us. Just providing your phone number and a text message are not required. If you give us your number, we can get in touch with you quickly if you have any questions. You agree to the storage of your telephone number for this purpose.
If you place an order without a customer account (“pay as a guest”), we process the data you enter exclusively for processing, executing and billing your purchase.
Unless we are legally obliged to store it for a longer period of time (e.g. by accounting regulations), we only store the data you provide when ordering for as long as necessary – in principle until the end of the legal deadline for claims from the purchase contract. If you give your consent or based on a legitimate interest, we will store it beyond this period.
If you create a customer account with us, we will save all the data provided (email address and password) as well as all purchases made with this account, including the data provided for this account, so that you can access them again later. The data will be stored until you delete your account, unless we are legally obliged to retain it for a longer period. If you give your consent or based on a legitimate interest, we will store it beyond this period.
The ordering process is handled by Shopify; all payments via our payment partner Stripe. We therefore do not collect any data about payment by credit card ourselves. The entire ordering process is encrypted via SSL.

13.4 Data collection and use when sending our newsletter
This website uses MailChimp services to send newsletters.
MailChimp is a provider that can be used, among other things, to organize and analyze the sending of newsletters. If you enter data for the purpose of subscribing to the newsletter (e.g. email address), it will be stored on WordPress servers.
Data processing is based on your consent (Art. 6 Para. 1 lit. a GDPR). You can revoke this consent at any time by unsubscribing from the newsletter. The legality of the data processing operations that have already taken place remains unaffected by the revocation.
The data you provide to us for the purpose of subscribing to the newsletter will be stored by us. If you unsubscribe from the newsletter, your contact will be excluded from sending mass emails through this account. If you want to exercise your right to deletion, please send a request to the newsletter sender.  If they do not respond within the appropriate time frame, please email us at  and we will delete it immediately. Deletion will then be carried out unless the data is required based on another legal basis in accordance with Article 6b-f (e.g. invoices, contractual relationships, etc.).

13.5 Data Use for Direct Advertising
We also use all the data you provide for direct advertising (e.g. for mailings or sending a newsletter you have ordered) in accordance with GDPR Article 6 Paragraph 1a or 1b. You can object to data processing for direct advertising at any time, free of charge, by sending a message to office (at) salomonwines.com. In the event of an objection, we will no longer process your data for this purpose.

13.6 Sharing of your information
We use the data you provide to fulfill the contract and strictly in accordance with legal regulations. For this purpose, if necessary, your data will be passed on to other companies, e.g. the post office, other parcel services and payment service providers. These companies act as “processors” for us and are only allowed to use your data to process specific orders. You are contractually obliged to us to comply with legal data protection regulations.
In the event of a legal regulation, an official order or an official investigation, we are obliged to make the relevant data available to the authority.

We save the contract text and send you the order confirmation by email.

The exclusive place of jurisdiction is A 3500 Krems/Donau. The base for the transaction is applicable Austrian law.
